These Terms and Conditions ("Terms") govern your access to and use of the FDK Consultancy website (the "Site") and any services provided by FDK Consultancy ("we," "us," or "our"), founded by Feras Al Darmi. By accessing the Site or engaging our services, you agree to be bound by these Terms.

1. Services FDK Consultancy provides HR strategy consulting, executive coaching, leadership programs, audits, Total Rewards design, and related services (collectively, the "Services"). Services are delivered based on separate agreements or proposals. These Terms supplement any specific engagement contract.

2. Eligibility You must be at least 18 years old and have the legal capacity to enter into agreements to use our Site or Services.

3. Intellectual Property All content on the Site, including text, graphics, the 6 Pillars Framework, workbooks, templates, and materials provided during Services, is owned by FDK Consultancy or licensed to us. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. Limited personal use is permitted for non-commercial purposes.

4. Client Responsibilities You agree to provide accurate information, cooperate fully, and implement recommendations at your own discretion. Results depend on your participation and are not guaranteed.

5. Limitation of Liability To the fullest extent permitted by law, FDK Consultancy shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the Site or Services. Our total liability shall not exceed the fees paid for the specific Service giving rise to the claim.

6. Indemnification You agree to indemnify and hold us harmless from any claims arising from your misuse of the Site/Services or breach of these Terms.

7. Termination We may terminate or suspend access to the Site/Services at any time for breach of these Terms.

8. Governing Law These Terms are governed by the laws of the State of Kuwait. Any disputes shall be resolved exclusively in the courts of Kuwait City.

9. Changes to Terms We may update these Terms at any time. Continued use constitutes acceptance.

Refund & Cancellation Policy

Due to the personalized, high-touch, and time-bound nature of our executive coaching, leadership programs, HR audits, strategy consulting, and other Services, we maintain a strict refund policy to respect the commitment of both parties.

General Policy

  • All fees for Services are non-refundable except as explicitly stated below or in your specific engagement agreement.

  • Payments are due as per the agreed schedule (e.g., upfront, installments). Once paid, fees are earned upon commitment of our time, preparation, and resources.

Specific Rules

  • 1:1 Coaching Sessions & Short Workshops: No refunds or credits for missed/cancelled sessions unless cancelled by us. If you cancel with less than 48 hours' notice, the full session fee is forfeited.

  • Multi-Session Programs (e.g., ADVANCE 6-Week, CHRO Accelerator): No refunds after the program commences. If you cancel before the first session (with at least 14 days' notice), a partial refund of up to 50% may be considered at our sole discretion, less any non-recoverable costs (e.g., materials, admin fees).

  • Audits & Strategy Projects: Deposits and milestone payments are non-refundable. Full refunds are not available once work has begun.

  • Digital Products/Workbooks (if sold separately): Non-refundable due to immediate delivery/access.

Exceptions Refunds may be considered in exceptional circumstances (e.g., serious illness documented by medical certificate) solely at FDK Consultancy's discretion. Requests must be submitted in writing within 7 days of the issue.

Confidentiality & Non-Disclosure Policy

Confidentiality Commitment At FDK Consultancy, confidentiality is fundamental — especially in HR, leadership, and organizational consulting where sensitive information is routinely shared. We treat all client information with the strictest confidence.

Our Policy

  • We do not disclose any client-specific information (including business strategies, employee data, compensation structures, audit findings, coaching discussions, or personal details) to third parties without your explicit written consent, except as required by law.

  • All consultants, contractors (if any), and team members are bound by strict confidentiality obligations.

  • Materials shared during engagements (e.g., workbooks, frameworks) remain proprietary to FDK Consultancy unless otherwise agreed.

Mutual Non-Disclosure In most engagements, we enter into a formal Mutual Non-Disclosure Agreement (NDA) or include confidentiality clauses in the service contract. Key terms typically include:

  • Definition of Confidential Information: Any non-public business, technical, financial, or personal information disclosed during the relationship.

  • Obligations: To use Confidential Information solely for the engagement purpose and not disclose it.

  • Duration: Survives termination of the engagement (usually 3–5 years or indefinitely for trade secrets).

  • Return/Destruction: Upon request, return or destroy all Confidential Information.

If your engagement does not include a separate NDA, these policy terms apply as a binding agreement.

Privacy of Personal Data We collect minimal personal data (name, email, company details) solely to deliver Services and communicate. We comply with applicable data protection laws (including Kuwait's Personal Data Protection Law where relevant). We do not sell your data. For full details, see our Privacy Policy below.
